RULE 1. APPLICATION OF TARIFF A) General. This Tariff sets forth the terms and conditions upon which
Reno Air, Inc., and, subject to Rule 500, Reno Air Express in consideration
of the payment of the applicable fare, agrees to provide passenger air transportation
between the points shown on a ticket. By purchasing a ticket and/or accepting
transportation on Reno Air or Reno Air Express, the purchaser of the ticket
and the applicable passenger acknowledges his or her acceptance of these
terms and conditions. The term "passenger" means the person or
persons in whose name or names the ticket is issued.
B) Carrier as Agent for Other Carriers. Carrier is responsible only for
furnishing of transportation over its own routes. When Carrier issues tickets,
checks or otherwise accepts custody of baggage, or makes any other arrangements
for transportation over the routes of other carriers, Carrier does so only
as an agent for such other carriers and assumes no responsibility or liability
whatsoever for the acts or omissions of such other carriers.
C) No Responsibility For Consequential Damages. PURCHASE OF A TICKET DOES
NOT GUARANTEE TRANSPORTATION. CARRIER SHALL IN NO EVENT BE LIABLE FOR ANY
INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE PERFORMANCE
OR DELAY IN PERFORMANCE OF, OR FAILURE TO PERFORM, TRANSPORTATION OF PASSENGERS
AND OTHER SERVICES INCIDENTAL THERETO WHETHER OR NOT CARRIER HAS KNOWLEDGE
THAT SUCH DAMAGES MIGHT BE INCURRED, EXCEPT AS SPECIFICALLY SET FORTH HEREIN.
D) No Responsibility for Services Other than Flights. Reno Air may at times
offer vouchers for accommodations, meals, alternative transportation (including
bus transportation) or other services to delayed or otherwise inconvenienced
passengers. To the extent any such compensation is provided, Reno Air does
not guarantee the type, quality or performance of the services, and its
sole warranty is that the voucher will be accepted by the party who is to
provide or perform the services. Without limitation, Reno Air shall not
be responsible for any delay, or other inadequacy of the services, or for
any injury, damage or loss of any kind resulting from the passenger's acceptance
or use of the services. This section does not obligate Reno Air to provide
any such compensation.
E) Changes in Rules, Fares and Charges. This Tariff is subject to change
without notice. Transportation is subject to the rules, fares and charges
in effect on the date on which such transportation commences at the first
point designated on the ticket. If, after a ticket has been issued and before
any portion thereof has been used, an increase or decrease in the fare or
charges applicable to the transportation covered by the ticket becomes effective,
the full amount of such increase or decreases will be collected from or
refunded to, the passenger, as the case may be. However, no increase will
be collected in cases where the ticket has been issued prior to the effective
date of a tariff containing an increase in the applicable local or joint
fare (see notes below) provided:
1) The originating flight coupon of the ticket was issued for a specific
flight at the fare contained in a tariff lawfully in effect on the date
of ticket issuance determined by the validation stamped or imprinted on
the ticket;
2) That subsequent to the effective date of any increase in the applicable
fare:
a) The originating flight is not voluntarily changed, and
b) Flights other than the originating flight are not voluntarily changed
to reflect a revised routing via which the original fare charged would not
have been applicable.
3) This provision shall apply only to the passenger to whom the ticket was
originally issued. Carrier shall have the right, but shall not be obligated,
to require identification of persons purchasing tickets and/or presenting
a ticket(s) for the purpose of boarding the aircraft.
NOTE 1: These provisions apply whether or not such increase results from
a change in fare level, change in conditions governing the fare, or a cancellation
of the fare itself.
NOTE 2: Purchase of a Prepaid Ticket Advice (PTA) will constitute ticketing
provided it is issued within tariff deadlines and reservation requirements
are met and shown in the PTA. Any cancellation, refund, or rerouting may
result in penalties against the PTA in the same manner as though a ticket
were issued. An open PTA will not constitute ticketing for any special fare
requirement.
NOTE 3: "Write Your Own" type tickets which are billed to the
customer only after use are considered to be issued on the date of use.
F) Fare and Booking Codes. Rules numbered 2000 and above contain particular
restrictions applicable to each of Reno Air's fares. (Each fare is identified
by a booking code; the booking code contains the restrictions applicable
to all fares available under such code.) The restrictions may limit the
ability of a passenger to change a reservation, and may restrict the refundability
of a ticket. On request, Reno Air will provide the restrictions applicable
to any fare.
Fares apply for travel only between the points for which they are published.
Tickets may not be issued at fare(s) published to and/or from a more distant
point(s), even when issuance of such tickets would produce a lower fare.
G) Alteration of Terms. No employee or agent of Reno Air may alter, amend,
modify or waive any of the provisions hereof unless authorized in writing
by a corporate officer of Reno Air. Employees, agents and representatives
of Reno Air are authorized to sell tickets for air transportation only pursuant
to approved fares, rules and regulations of Reno Air.
H) Free or Reduced Rate Tickets. Tickets issued at prices less than a published
fare or for free are subject to such additional rules and regulations as
Reno Air may promulgate from time to time.
RULE 5. DEFINITIONS Air Traffic Conference (ATC) is the division of the Air Transport Association
responsible for coordinating interline operations and agreements between
carriers/tour wholesalers/travel agents.
Air Transport Association of American (ATA) is the trade association of
US and Canadian (as associate members) scheduled air carriers.
Applicable Adult Fare means the fare which would be applicable to an adult
for the transportation to be used except those special fares which would
be applicable to the passenger's status; e.g., military fares, adult standby,
etc.
Baggage means such personal property of a passenger holding a valid ticket
for travel on a flight which is tendered for transport on such flight.
Carrier means Reno Air and/or Reno Air Express.
Circle Trip means any trip, the ultimate destination of which is the point
of origin, but which includes a stop at least one other point, and which
is not made via the same routing/carrier in both directions.
Coach means the service on flights listed in the carrier's official general
schedules as Tourist, Coach, Day Coach, Deluxe Coach.
Co Terminal means two (2) or more relatively adjacent airports, which for
the purpose of fares, will be considered the same point.
Continental United States means the District of Columbia and all states
of the United States other than Alaska and Hawaii.
Contractor means any person who has entered into a contract with a carrier
for the purchase of seats for resale to the general public.
Days means full calendar days, including Sundays/legal holidays; provided
that for the purposes of notification the balance of the day on which notice
is dispatched shall not be counted; and that for purposes of determining
duration of validity, the balance of the day on which the ticket is issued
or flight commenced shall not be counted.
Dependent unless otherwise indicated, means spouse and children wholly dependent
upon the head of a household for their livelihood.
Domestic Carriage means carriage in which the place of departure, the place
of destination or stopover, and the entire transportation are within the
United States of America, as defined in the contract of carriage.
D.O.T. means the Department of Transportation.
D.O.T. Hazardous Materials Regulations means the Hazardous Material Regulations
issued by the Materials Transportation Bureau of the Department of Transportation
in Title 49 of the Code of Federal Regulations, Parts 171 through 177 (49
CFR 171.177).
Economy means the service listed in the carrier's official general schedule
as Economy flights.
First Class means the service on flights listed in the carrier's official
general schedule as First Class.
Flight Coupon means a portion of the passenger's ticket that indicates particular
places between which the coupon is good for transportation.
Full Adult Fare means the one-way fares designated by fare class code Y
whether specifically published or derived by construction.
Government Transport Request (GTR) is a form used for ticket payment and
travel authorization for passengers traveling on official business for the
Federal Government of the U.S.
Group is defined as the minimum number of passengers specified in conjunction
with the fare as provided for in the applicable fare rules. Less than the
minimum number of passengers may not travel at group fares, even upon payment
of the minimum number of fares, unless specifically permitted in a given
fare rule.
Immediate Family means spouse, children, adopted children, sons-in-law,
daughters-in-law, grandchildren, brothers, sisters, brothers-in-law, sisters-in-law,
parents, fathers-in-law, mothers-in-law and grandparents.
Interlining means utilizing the service of more than one carrier in connection
with a particular fare.
International Carriage means carriage in which, according to the contract
of carriage, the point of departure or any point of landing are situated
in more than one nation.
Maximum Outside Linear Dimensions means the sum of the greatest outside
length, plus the greatest outside width, plus the greatest outside height.
Military Passenger means military personnel of the U.S. military agencies
who are on active duty status or who have been discharged from active military
service within seven days of the date of travel.
Online means air transportation wholly on the same carrier.
Open Jaw Trip means any trip which is essentially of a round-trip circle-trip
nature, except that the outward point of departure and the inward point
of arrival or the outward point of arrival and inward point of departure
are not the same. In a double open-jaw trip, both sets are not the same.
Passenger means any person, except members of the crew, carried or to be
carried in an aircraft with the consent of the carrier.
Prepaid Ticket Advice or PTA means the notification between offices of a
carrier or between carriers that a person in one location has purchased
and requested issuance of prepaid transportation to another person in another
location.
Reno Air means Reno Air and any subsidiary thereof which delivers air transportation.
Reno Air Express means any airline operating aircraft with 30 or less seats
which has written permission from Reno Air to designate its flights with
Reno Air's QQ designator code. Reno Air Express flights are indicated by
flight numbers 1500 through 1699 and 4000 and higher.
Reroute means transportation to the same destination as indicated on the
ticket then held by the passenger, but via a different routing than that
designated on the ticket.
Round Trip means any trip, the ultimate destination of which is the point
of origin, and which is made via the same routing in both directions.
Routing means the carrier(s) and/or the cities and/or class of service and/or
type of aircraft on which transportation is provided between two (2) points.
Schedule means the Carrier's official schedule at any point in time, as
maintained by its Director of Operations.
Segment means that part of a journey indicated by a separate flight coupon.
Standby Passengers means passengers who hold standby tickets allowing them
to be enplaned on a flight subject to availability of space at departure
time after accommodation of other passengers.
Stopover means a deliberate interruption of a journey by the passenger,
agreed to in advance by the carrier, at a point between the place of departure
and the place of destination. Unless otherwise noted, stopover will occur
when a passenger arrives at a point and fails to depart from such point
on:
a) The first flight on which space is available, or,
b) The flight that will provide for the passenger's earliest arrival at
the next point on his itinerary via the carrier and class of service as
shown on the passenger's ticket, provided however, that in no event will
a stopover occur when the passenger departs from the intermediate/junction
point on a flight shown in the carrier's Schedule as departing within four
hours after arrival at such point.
Ticket means the "passenger ticket and baggage check," including
all flight, passenger and other coupons contained therein, issued by carrier,
which provides for the carriage of the passenger and his/her baggage.
Tour Conductor is a person at least eighteen (18) years of age, who is in
charge of and guides a group for the duration of a tour.
Transit Point is any stop at an intermediate point on the route to be traveled
(whether or not a change of planes is made) which does not fall within the
definition of a stopover.
United States of America (USA) means the fifty (50) federated states and
the District of Columbia, Puerto Rico, the Virgin Islands, American Samoa,
The Canal Zone, Guam, Midway, and Wake Islands.
United States Department of Defense means the U.S. Departments of Defense,
Army, Navy, Coast Guard and Air Force.
U.S. Armed Forces/U.S. Military Agencies means the Army, Navy, Air Force,
Marine Corps, and Coast Guard of the United States of America; the respective
academies of the Army, Navy, Air Force and Coast Guard, and does not include
the National Guard Bureau or the Reserve Officer Training Corps, or members
of the reserves not holding a valid Duty Armed Forces of the United States
green identification cards.
USDA means the United States Department of Agriculture.
U.S. Military Personnel unless otherwise indicated, refers only to active
duty military personnel, and means military personnel of the United States
military agencies holding a valid active duty armed forces of the United
States green identification card on active duty status and traveling on
authorized furlough, leave or pass.
Virgin Islands means the Virgin Islands of the U.S.
Waitlist means a list, established by carrier, of passengers who are either
seeking space on a flight that is sold out, or traveling on a standby basis/standby
fare.
RULE 15. VALIDITY OF FARES A fare is a valid fare only if booked at a time when seats are available
on a specific flight in the booking class applicable to such fare and all
other restrictions applicable to such fare are complied with or specifically
waived by the Carrier. Agents of Carrier do not have authority to waive
any such restrictions. Any fare or booking class may have limited availability
and may not be available on all flights.
RULE 24. TAX Unless otherwise stated, any tax, excise tax, passenger facility charge
or other charge imposed by government authority and collectable from a passenger
will be in addition to the published fares and charges.
RULE 35. REFUSAL TO TRANSPORT Carrier may refuse to transport or may remove from its aircraft at any
point, any passenger when a seat is not available (for any reason) or:
A) Government Request or Regulations - Whenever such action is necessary
to comply with any law or government regulation or request.
B) Refusal to Cooperate - If the person fails or refuses to comply with
the rules, regulations, and reasonable directions of Carrier.
C) Search of Passengers, or Property - If the person refuses to permit search
for security purposes of his/her person or property.
D) Proof of Identity - If the person refuses on request to produce identification.
E) Across International Boundaries - If the person is traveling across any
international boundary and:
1) The travel documents of such passenger are not in order; or
2) For any reason, such passenger's embarkation, transit through, or entry
into, any country from, through, or to which such passenger desires transportation
would be unlawful.
F) Comfort and Safety - If refusal or removal of the person is considered
necessary for the comfort and safety of themselves or other passengers because
such person:
1) Exhibits conduct which is disorderly, abusive, or violent;
2) Is barefoot;
3) Is unable to sit upright in an airline seat with the seat belt fastened;
4) Appears to be intoxicated or under the influence of drugs;
5) Appears to have a communicable disease or infection determined by federal
public health authorities knowledgeable about the disease or infection to
be transmittable during the normal course of the flight;
6) Has a malodorous condition;
7) Requires an onboard stretcher, medical oxygen, an incubator, a respirator/ventilator
hooked up to the aircraft electrical power supply, intravenous or intramuscular
feeding, or comparable medical devices during flight;
8) Is of unsound mind, or whose behavior is reasonably considered to be
hazardous to themselves, the crew, or other passengers;
9) Is a prisoner of the law (including persons held in custody) who must
be manacled or who may reasonably be believed poses a danger to the aircraft,
crew or other passengers;
10) May be refused transportation under Part 382 of Title 14 of the Code
of Federal Regulations (Nondiscrimination on the basis of handicap);
11) Attempts to interfere with any member of the flight crew in the pursuit
of their duties;
12) In the sole judgment of Carrier, poses an unreasonable risk or inconvenience
to himself or to other passengers.
RULE 35A. HANDICAPPED PASSENGERS For safety-related reasons, Carrier may require a competent attendant
to accompany a passenger:
1) Who because of mental disability is unable to comprehend or respond to
safety related instructions;
2) Who has both a severe hearing and vision impairment such that he is unable
to establish a means of communication with Carrier personnel sufficient
to receive the safety briefing;
3) Who has a mobility impairment so severe that he/she would be unable to
assist in his or her evacuation of the aircraft in the event of an emergency.
The attendant will be responsible for caring for the passenger enroute or
in the event of an emergency.
If the passenger asserts that he or she can travel independently but in
the opinion of Carrier personnel, the passenger must travel with an attendant,
Carrier will transport the attendant without charge.
Carrier requires 24-hour advance notice and one hour advance check-in for
accommodation of a group of ten (10) or more handicapped individuals who
are traveling as a group.
RULE 40. ELECTRONIC SURVEILLANCE OF PASSENGERS AND BAGGAGE Passengers and their baggage are subject to inspection with an electronic
detector with or without the passenger's consent or knowledge.
RULE 50. ACCEPTANCE OF UNACCOMPANIED CHILDREN A) Children under twelve (12) years of age who are not accompanied on
the same flight and in the same compartment by a passenger twelve (12) years
of age or over are accepted only under the following conditions:
1) Unaccompanied children under five (5) years of age are not accepted for
transportation under any condition;
2) Unaccompanied children at least five (5) years of age, but under eight
(8) years of age are accepted for on-line transportation only when through
service is provided without change of aircraft;
3) Unaccompanied children at least eight (8) years of age, but under twelve
(12) years of age will be accepted for on-line transportation with or without
change of aircraft;
4) To be accepted for transportation, the child must be brought to the airport
at least thirty (30) minutes prior to the scheduled departure by a parent
or responsible adult who must remain with the child until enplaned and furnish
Carrier with a commitment (including any reasonably requested verification)
that the child will be met by another parent or responsible adult upon deplaning
at his/her destination;
5) All travel must be on flights on which the child holds confirmed reservations
from the airport of origin to the first point of stopover where the child
is to be met by a parent or responsible adult upon deplaning;
6) Carrier reserves the right to refuse to transport an unaccompanied child
if there is a reasonable possibility that the flight on which the child
holds a reservation will be diverted to an alternate airport;
7) Carrier reserves the right to refuse to transport an unaccompanied child
who resists or refuses unaccompanied transportation; and
8) Carrier does not assume any financial or guardianship responsibilities
for unaccompanied children beyond those applicable to an adult passenger.
B) A $25 Escort Fee will be assessed each way in addition to the applicable
fare, with respect to children making an on-line connection. Upon request,
the same escort service is available to passengers ages 12-17 at the applicable
$25 fee. A single $25 escort fee will be charged each way for 2 or more
children traveling together on the same itinerary.
RULE 55. ANIMALS TRAINED TO ASSIST HANDICAPPED INDIVIDUALS Carrier will accept for transportation, without charge, a properly harnessed
bona-fide service animal trained to assist a handicapped individual when
it accompanies such individual. The animal will be permitted to accompany
such passenger into the cabin, but will not be permitted to occupy a seat,
except such passenger's seat. Service animals may not obstruct an aisle
or other area that must remain unobstructed in order to facilitate an emergency
evacuation.
RULE 90. OXYGEN SERVICE Carrier does not provide inflight oxygen service for a passenger's personal
use on any of its flights, and does not accept personal oxygen equipment
for transportation on any flights.
RULE 95. LIMITATIONS ON CLAIMS A) Carrier will not be liable for any loss of, damage to, or delay in
the delivery of baggage or other property unless:
1) The passenger orally or in writing notifies Reno Air of the loss or delay
within four (4) hours after the arrival of the flight on which the baggage
or property was to have been transported and provides his or her valid claim
check and any additional information reasonably requested by Carrier;
2) The passenger provides Reno Air written notice of the claim, at any of
its offices, within fifteen (15) days after the alleged occurrence of the
events giving rise to the claim, unless the passenger can show good cause
for the failure to give such notice in a timely manner; and
3) Any legal action against Carrier is commenced within one (1) year after
the occurrence of the events giving rise to the claim.
B) Carrier will not be liable for any other claim arising from, out of,
or in any way connected with the terms and conditions in this Contract of
Carriage, or for any act or failure to act on the part of Carrier, or any
of its officers, agents or employees, (including, without limitation, any
action for bodily injury, death, personal injury or property damage) unless:
1) Written notice of the claim is given to Reno Air at any of its offices
within fifteen (15) days after the alleged occurrence of the events giving
rise to the claim, unless the passenger can show good cause for the failure
to give such notice in a timely manner;
2) Any legal action is commenced within one (1) year after the occurrence
of the events giving rise to such claim.
C) Carrier hereby incorporates and agrees to any provision of law or international
treaty limiting liability of Carrier. Without limitation, Carrier avails
itself of the limitation of liability provided in the Convention for the
Unification of Certain Rules Relating to International Carriage by Air,
signed at Warsaw October 12, 1929, or provided in the said Convention as
amended by the Protocol signed at The Hague, September 28, 1955. However,
in accordance with Article 22 (1) of said Convention, or said Convention
as amended by said Protocol, Reno Air agrees that, as to all international
transportation by Reno Air in conjunction with other carriers as defined
in the said Convention, or said Convention as amended by said Protocol,
which, according to the Contract of Carriage, includes a point in the United
States of America as a point of origin, point of destination, or agreed
stopping place:
1) The limit of liability for each passenger for death, wounding or other
bodily injury shall be the sum of US $75,000, inclusive of legal fees and
costs, except that, in case of a claim brought in a State where provision
is made for separate award of legal fees and costs, the limit shall be the
sum of US $58,000 exclusive of legal fees and costs.
2) Carrier shall not, with respect to any claim arising out of the death,
wounding or other bodily injury of a passenger, avail itself of any defense
under Article 20 (1) of said Convention or said Convention as amended by
said Protocol.
Nothing herein shall be deemed to affect the rights and liabilities of Carrier
with regard to any claim brought by, on behalf, or in respect to any person
who has caused damage which resulted in death, wounding, or other bodily
injury of a passenger.
RULE 100. TICKETS A) No person shall be entitled to transportation except upon presentation
of a valid ticket. Such ticket shall entitle the passenger to transportation
only between points of origin and destination and via the routing designated
thereon.
B) Flight coupons will be honored only in the order in which they are issued,
and only if all unused flight coupons and passenger coupons are presented
together.
C) A ticket which has not been validated, or which has been altered, mutilated
or improperly issued, shall not be valid.
D) Tickets are not transferable, but Carrier is not liable to the owner
of a ticket for honoring or refunding such ticket when presented by another
person.
E) Unless otherwise provided, purchase of a Prepaid Ticket Advice (PTA)
will constitute purchase and issuance of ticket.
NOTE: For fares requiring special reservations and ticketing requirements,
the PTA will constitute ticketing provided it is issued within tariff deadlines
and reservation requirements are met and shown in the PTA. Any cancellation,
refund, or rerouting will result in penalties again the PTA in the same
manner as though a ticket was issued. An open PTA will not constitute ticketing
for any special fare requirement.
F) In the event of an inconsistency between a ticket and the passenger name
record (PNR) maintained in Reno Air's reservation system, the PNR shall
be controlling and shall establish the passenger's confirmed reservation.
RULE 105. TICKET VALIDITY A) Period of Validity. Except as further limited elsewhere in this Tariff
or on the ticket, a ticket will be valid for transportation for one (1)
year from the date on which transportation commences at the point of origin
designated on the original ticket or, if no portion of the ticket is used,
from the date of issuance of the original ticket.
B) Extension of Validity; Waiver of Special Fare Restrictions
1) If the passenger is prevented from using the ticket, or a portion of
the ticket, during the period of validity specified in paragraph A) above,
due to lack of space or flight cancellation, the ticket will remain valid
until space can be provided to the passenger.
2) If the passenger is unable to commence or continue his/her travel due
to illness, injury or physical incapacity of himself/ herself or a member
of his/her immediate family, or of an associate with whom he/she is traveling
or the death of a member of his/her Immediate Family, or an associate with
whom he/she is traveling, Carrier will extend the period of validity not
to exceed thirty (30) days beyond the original limit.
NOTE: The above provisions will also apply if the passenger is unable to
commence or continue his/her travel due to the death of a member of his/her
Immediate Family, or an associate with whom he/she is traveling.
3) If a passenger having a partially used excursion or special fare ticket
is required, due to illness, injury or physical incapacity of him/herself
or a member of his/her Immediate Family or the death of a member of his/her
Immediate Family, or an associate with whom he/she is traveling, to commence
his return travel prior to the earliest date permitted under the rules applicable
to such excursion or special fare, Reno Air will waive the travel date restrictions
affixed to such excursion or special fare ticket.
NOTE: Carrier may require presentation of a death certificate or physician's
certificate attesting to the illness, injury or physical incapacity and
the need to alter the passenger's itinerary. If the medical certificate
or death certificate is not available at the time the passenger is to travel,
or, if Carrier has reason to doubt the validity of such certificate, the
passenger will be accommodated only upon payment of the fare applicable
to transportation actually used, and a request for refund may be filed with
Carrier. Upon receipt of the claim and all supporting documents and after
determining the validity of the claim, Carrier will refund to the passenger
the difference between the total fare paid by the passenger and the amount
the passenger would have paid under the provisions of this rule.
RULE 115. CONFIRMATION OF RESERVED SPACE A) A reservation for space on a given flight is confirmed when the availability
and allocation of such space is confirmed by a reservation agent of Reno
Air or its authorized representative. Subject to payment or satisfactory
credit arrangement, a validated ticket will be issued by Reno Air or its
authorized representative indicating such confirmed space, provided the
passenger applies for such ticket at least thirty (30) minutes prior to
the scheduled departure time of the flight to which such reservation applies.
Such reservation is subject to cancellation by Carrier, without notice,
if a passenger has not obtained a validated ticket specifying his/ her confirmed
reserved space at least thirty (30) minutes prior to the scheduled departure
time of the flight to which such reservation applies.
EXCEPTION: If a condition of a fare is that a passenger obtain a ticket
by a time more than thirty (30) minutes prior to scheduled departure time,
the passenger will be advised of such condition at the time the reservation
is made and such condition will be recorded in Reno Air's reservations system.
The reservation of such passenger is subject to cancellation by Carrier
without notice if the ticket has not been purchased prior to the required
time.
B) In the event of an inconsistency between a ticket and the passenger name
record (PNR) maintained in Reno Air's reservation system, the PNR shall
be controlling and shall establish the passenger's confirmed reservation.
C) Carrier flights are subject to overbooking which could result in Carrier's
inability to provide previously confirmed space for a given flight or for
the class of service reserved. In that event, Carrier's obligation to the
passenger is governed by RULE 245.
RULE 115A. ADVANCE SEAT ASSIGNMENTS Advance seat assignments may be provided by Reno Air as a convenience.
Advance seat assignments are not a guarantee that a seat will be available.
Reno Air will have no liability for failure to provide an assigned seat
if it provides an alternative seat in the same class of service on the applicable
flight.
RULE 135. CANCELLATION OF RESERVATIONS A) Carrier will cancel reservations of any passenger whenever such action
is necessary to comply with any governmental regulation, or to comply with
any governmental request for emergency transportation in connection with
the national defense, or whenever such action is necessary or advisable
by reason of weather or other conditions beyond its control.
B) If a passenger fails to utilize a confirmed reservation on a Carrier
flight and fails to notify Carrier and cancel the confirmed reservation
prior to the departure of such flight, Carrier may cancel all reservations
held by such passenger on the flights of Carrier for continuing or return
transportation.
C) Airport check-in time limits:
1) Carrier may cancel the reservation and/or the seat assignment of any
passenger who fails to present himself/herself for check-in (or boarding)
with a valid ticket at the boarding gate at least fifteen (15) minutes before
the scheduled departure time of any domestic flight.
2) Carrier may cancel the reservation and/or the seat assignment of any
passenger who fails to present himself/herself for check-in (or boarding)
with valid ticket at the boarding gate at least sixty (60) minutes before
the scheduled departure time of any international flight.
3) These rules also apply to passengers who are delayed due to the late
arrival of an inbound connecting flight of Carrier or another airline, but
such passengers may be entitled to the benefit of other terms of this Contract
of Carriage.
RULE 180. STOPOVERS Stopovers will be permitted only upon payment of the combination of
applicable fares. A stopover, as used herein, will occur when a passenger
arrives at an intermediate or junction transfer point on a flight on any
carrier, and fails to depart from such intermediate or junction transfer
point on the next flight designated on the ticket or the first flight on
which space is available on the carrier designated on the ticket, traveling
to the passenger's next destination. In no event, however, will a stopover
occur when the passenger departs from the stopover point on a flight scheduled
to depart within four (4) hours after the passenger's arrival at such point.
RULE 190. ACCEPTANCE OF BAGGAGE: GENERAL A) General Conditions of Acceptance. Carrier will accept for transportation
as baggage, such personal property as is necessary or appropriate for the
wear, use, comfort, or convenience of the passenger for the purpose of the
trip, subject to the following conditions:
1) All baggage is subject to inspection by Carrier. However, there is no
obligation that Carrier perform an inspection. Carrier may refuse to transport
or remove at any point baggage that the passenger refuses to submit for
inspection.
2) Carrier may refuse to transport baggage on any flight other than the
flight carrying the passenger. For security reasons, Reno Air may refuse
to check baggage more than four (4) hours in advance of the passenger's
scheduled departure time.
3) Carrier may refuse to accept property for transportation as checked baggage
which size, weight, or character renders it unsuitable for transportation
on the particular aircraft which is to transport it or which cannot be accommodated
without harming or annoying passengers.
4) Carrier may refuse to accept baggage or which is not suitable or adequately
packaged to withstand ordinary handling, unless the passenger has executed
a limited release form.
5) Carrier will check baggage which is tendered by a passenger only upon
presentation by the passenger of a valid ticket for transportation commencing
over the routes of Carrier.
6) Where an itinerary involves interline transportation the baggage rules
of all other carrier providing a portion of the transportation also apply.
7) Carrier does not agree to carry and assumes no liability for valuable/commercial
items including but not limited to money, negotiable papers, securities,
irreplaceable business documents/books, manuscripts/publications, jewelry,
silverware, precious metals, furs, antiques, artifacts, specialized/calibrated
equipment, musical equipment, photographic equipment including but not limited
to video cameras and their accessories, electronic equipment including but
not limited to computers, computer printers and their accessories, lifesaving
medication, samples, liquids or perishable items except as provided for
in RULE 195.
8) The passenger's name must appear on the baggage.
9) Baggage will not be checked to a point that is not on the passenger's
routing.
B) Size/Weight Limitations. No article will be accepted if the maximum outside
linear dimensions exceed eighty (80) inches or if the article weighs more
than seventy (70) pounds.
EXCEPTION 1: Reno Air will accept one article weighing more than seventy
(70) pounds but less than eighty (80) pounds tendered by a representative
of the United States Secret Service or White House Communications Agency.
EXCEPTION 2: More restrictive limitations may apply to specific aircraft
(RULE 190.A.3).
C) Acceptance of Special Items and Live Animals. Special items listed in
RULE 195 will only be accepted in accordance with the additional provisions
and/or charges specified in that rule. Live animals will only be accepted
in accordance with the additional provisions and/or charges specified in
RULE 200.
D) Delivery of Checked Baggage by Reno Air.
1) Carrier undertakes solely to deliver checked baggage to the carousel
or other general baggage retrieval point at the location to which the baggage
is checked. Carrier will not be responsible for damage or loss to baggage
that occurs after the time at which the baggage is delivered to such point.
2) Carrier may refuse to release baggage to any individual who does not
possess the baggage claim stub or other suitable evidence of ownership.
Under no circumstances, however, does Carrier undertake any obligation to
prevent baggage from being improperly retrieved by a person not entitled
to such baggage.
3) At the request of the bearer of the baggage check and baggage (claim)
tag(s), Carrier may attempt to retrieve checked baggage at the place of
departure or an intermediate stopping place upon, unless precluded by government
regulations or unless time and circumstances do not permit. In delivering
baggage at the place of departure or at any intermediate stopping place,
Carrier shall be under no obligation to refund any charges paid.
4) Carrier may refuse to check baggage may if the baggage is not presented
for check-in at least fifteen (15) minutes prior to flight departure time
or the passenger is traveling on a standby basis. Such baggage may be checked
upon execution of a release relieving Carrier from liability for failure
of the checked baggage to arrive on time.
RULE 195. CONDITIONS FOR ACCEPTANCE OF SPECIAL ITEMS The following items will be accepted by Carrier subject only to specified
conditions and payment of additional charges shown.
A) Bassinets and Infant Carrying Seats. On jet aircraft with more than 60
seats, an infant's carrying seat will be accepted in the passenger cabin,
subject to FAA regulations, when an additional seat is reserved for the
infant, a ticket is purchased, and the bassinet or carrying seat is FAA
certified and can be properly secured by the seat belt. Bassinets and infant
carrying seats may not be allowed on smaller aircraft.
B) Firearms. Except as permitted by Federal Aviation regulations, non-sporting
firearms and ammunition will be accepted as checked baggage only.
C) Fragile Items, Liquids and Perishable. Fragile and/or perishable items
(described below) will be accepted only if they are appropriately packaged
in an original factory carton, cardboard mailing tube, or container or case
designed for shipping such items packed with protective internal material.
Fragile items without appropriate packaging may be accepted upon the execution
of a release relieving Carrier of liability for loss or damage of contents
or delay in delivery. Without limitation of other fragile or perishable
items, the classes of items listed below may be deemed by Carrier to be
fragile or perishable or otherwise unsuitable as checked baggage and thereby
subject to the conditions of acceptance specified above:
a) Art work, including paintings, drawings, statues or other sculptures,
pottery, plastics, molds, casts, pictures, photographs, display models,
antique furniture or items.
b) Backpacks and knapsacks.
c) Corrugated/cardboard boxes, sacks, or paper or plastic bags.
d) Electronic and mechanical items, including televisions, stereos, audio/visual
equipment and office equipment.
e) Garment bags made of paper, light plastic, or vinyl material designed
for carrying and not for shipping and garment bags (and contents) that contain
articles other than garments.
f) Glass and other easily breakable items, including terrariums, fish tanks,
mirrors, crystal, and china.
g) Musical instruments and equipment.
h) Ornamental items, including sconces, decorative screens, decorative items,
stones/marble/onyx/alabaster, vases, figurines, trophies, souvenirs and
other decorator objects and curios.
i) Over packed baggage.
j) Paper items, including advertising displays, models, sketches, blueprints,
and maps.
k) Perishable items, including fresh or frozen foodstuffs such as fruits,
vegetables, meats, fish, poultry and bakery products, floral and nursery
stock such as flowers, fruit, and vegetable plants and cut flowers and foliage
such as floral displays.
l) Photographic/Cinematographic equipment, including cameras, lenses, flash
bulbs, projectors, photoflash equipment, photometers, spectroscopes, phototubes
and other devices using sensitive tubes or plates.
m) Precision items, including microscopes, oscilloscopes, meters, counters,
and polygraphs.
n) Recreational and sporting goods, including fishing rods, scuba diving
gear, and model airplanes.
o) Toys, including dollhouses, and model trains and airplanes.
p) Unprotected items, including infant strollers, umbrellas, sleeping bags,
either individually checked or tied/strapped to the outside of a bag.
D) Restricted Articles: Reno Air will not carry or handle hazardous materials.
Hazardous materials include the following:
1) Explosives.
2) Gasses (compressed, liquefied, dissolved under pressure).
3) Flammable liquids.
4) Flammable solids. (Substances liable to spontaneous combustion and substances
which emit flammable gasses on contact with water.)
Exceptions are provided for certain amounts of dry ice, medicinal and toilet
articles, and, to the extent allowed herein, a wheelchair battery.
E) Sporting Equipment.
All sporting equipment must be appropriately packed. Sporting equipment
not appropriately packed may be transported upon execution of a release
relieving Carrier of liability for loss or damage of contents or delay in
delivery.
1) Bicycling Equipment. Reno Air will accept non-motorized touring or racing
bicycles with single seats. Bicycles must have the handlebars fixed sideways
and the pedals removed, or be placed in cardboard containers, or the pedals
and handlebars must be encased in plastic foam or similar material. Bicycles
will not be included in determining the free baggage allowance and will
always be subject to a one way $45 charge per bicycle, whether or not presented
as a single piece.
NOTE: Bicycles are not accepted for transport on Reno Air Express flights.
2) Bowling Equipment. Bowling equipment will be included in determining
the free baggage allowance, and when in excess, will be subject to the excess
baggage charge.
3) Fishing Equipment. Fishing equipment will be included in determining
the free baggage allowance, and when in excess, will be subject to the excess
baggage charge.
4) Golfing Equipment. Golfing equipment will be included in determining
the free baggage allowance, and when in excess, will be subject to the excess
baggage charge.
5) Scuba Diving Equipment. Scuba diving equipment will not be included in
determining the free baggage allowance and will always be subject to a one
way $45.00 charge per item whether or not presented a single piece. (For
the purpose of this provision one (1) item of scuba diving equipment is
defined as one (1) scuba tank empty or less than forty (40) PSI, one (1)
scuba regulator, one (1) tank pressure gauge, one (1) mask, two (2) fins,
one (1) snorkel, and one (1) safety vest.)
6) Sporting firearms. Firearms must be unloaded and packed in a manufacturer's
crushproof type container manufactured specifically for the firearms or
in any hard side container or cover deemed suitable by Reno Air. Baggage
containing handguns must be locked with a key or lock combination in possession
of the passenger only, and the bag must be of hard side type or the firearm
must be in a hard side container. Baggage containing firearms will be transported
in an area, other than the cockpit, that is inaccessible to passengers.
Baggage containing firearms will not knowingly be accepted for transportation
unless a declaration, signed and dated on the day the baggage is accepted
for transportation, is attached to the inside of the case declaring that
the firearms are not loaded.
Ammunition must be packed in the manufacturer's original package or in a
container of sufficient strength to protect it from accidental crushing
or discharge. Ammunition with explosive or incendiary projectiles will not
be accepted. Ammunition is not to exceed ten (10) pounds per passenger.
The maximum gross weight of ammunition accepted for carriage on any one
jet aircraft is limited to one hundred (100) pounds and to ten (10) pounds
total on any Reno Air Express flight.
Firearms and ammunition will be included in determining the free baggage
allowance, and any excess will be subject to the excess baggage.
7) Skiing Equipment. Skiing equipment will be included in determining the
free baggage allowance, and when in excess, will be subject to the excess
baggage charge.
8) Surfboards. Surfboards will be accepted based on availability of space
and upon execution of a limited release from Reno Air. Surfboards are not
accepted on Reno Air Express flights. Surfboards will not be included in
determining the free baggage allowance and will always be subject to a one
way $45.00 charge per surfboard.
9) Tennis Equipment. Tennis rackets will be accepted as checked baggage
only upon execution of a release form from Reno Air and will be included
in determining the free baggage allowance, and when in excess, will be subject
to the excess baggage charge.
10) Windsurfing Equipment. Windsurfing equipment will not be accepted for
transportation on Reno Air.
NOTE: Any other types of sporting equipment not mentioned above, but deemed
fragile or unsuitable packaged by a Carrier representative at the time of
check-in, will be accepted for transportation as checked baggage only upon
the execution of a limited release form. Carrier reserves the right to refuse
to accept for transport any sporting equipment that is physically too large
to fit in the cargo hold.
F) Wheelchairs. Reno Air accepts wheelchairs for transportation as checked
baggage in accordance with the "Non-Discrimination on the Basis of
Handicap Rule" and the following safety guidelines. The wheelchair
can be no taller than thirty-eight (38) inches or the limitations of the
cargo hold, if smaller and subject to conditions specified below. Wheelchairs
which are accepted will be in addition to the basic free baggage allowance
and at no charge when checked by a passenger that requires the wheelchair.
1) Dry Cell Batteries. Wheelchairs powered by dry cell batteries are accepted
for transportation as checked baggage provided the cables from the battery
terminal are disconnected and taped to prevent short circuit.
2) Non-spillable Electric Storage Batteries. For the purpose of this provision,
a non-spillable storage battery is a wet cell battery which does not have
filler caps, vents or other removable plugs which would permit leakage or
spillage. Wheelchairs powered by this type of battery will be accepted for
transportation as checked baggage provided the cables from the battery terminals
are disconnected and taped to prevent short circuit.
3) Spillable Wet Cell Batteries. Wheelchairs powered by spillable wet cell
batteries will be accepted for transportation, provided the wet cell battery
is housed in a protective kit available from Reno Air or a similar container
approved by Reno Air, and Carrier is provided 24-hour advance notice if
passenger is not providing the container.
RULE 200. CONDITIONS AND CHARGES FOR ACCEPTANCE OF LIVE ANIMALS Reno Air will accept for transportation as checked baggage, subject
to the conditions and charges specified in paragraph A), B) and C) below,
only domesticated dogs, cats, and birds which are kept as personal pets
or as show or exhibition animals, and which can in no way be considered
dangerous or offensive to passengers or baggage handling personnel.
One (1) domesticated bird, cat or dog, per jet flight will be accepted for
transportation in the passenger cabin provided it is kept in a suitable
container which is kept under the passenger's seat and subject to the conditions
and charges specified in paragraphs A), B) and C) of this rule.
A) General Conditions of Acceptance.
1) Acceptance will be subject to USDA Animal Welfare Act provisions.
2) Carrier must be notified at least twenty-four (24) hours prior to scheduled
departure time.
3) The animal must be harmless, inoffensive, odorless, and require no attention
during transfer.
4) The passenger must make all arrangements and assume full responsibility
for complying with any applicable laws, and/or other governmental regulations,
requirements, or restrictions of the country, state, or territory to which
or through which the animal is being transported.
5) Each animal must be in a separate container.
EXCEPTION: Reno Air will accept two (2) puppies or kittens, three (3) weeks
to six (6) months of age, not weighing over twenty (20) pounds in the aggregate,
in the same container, or a litter of weaned puppies or kittens less than
eight (8) weeks old, accompanied by their dam in the same container.
6) Live animals will not be checked through a transfer to another airline.
7) Live animals are not accepted for interline transportation to or from
international points.
B) Containers.
1) The animal must be confined in a container subject to inspection and
approval of Carrier prior to acceptance.
2) Containers used to transport live animals must be leakproof; be made
of metal, wood or polyethylene; be ventilated on at least two (2) sides
and permit the animal to stand in a normal manner. Carrier will not accept
live animals in containers that have a gross weight, including the weight
of the animal, of more than one hundred (100) pounds.
EXCEPTION: Dangerous or aggressive animals such as pit bull dogs will be
accepted only in containers made of metal.
3) The passenger is responsible for insuring that the container meets all
governmental requirements for the safe and humane transportation of the
animal being transported.
4) The maximum combined outside linear dimensions of the container may not
exceed one hundred fifteen (115) inches.
5) Reno Air will accept no more than two (2) containers per flight without
prior approval.
C) Charges.
1) The animal and its container will not be included in determining the
free baggage allowance and will always be subject to a $45 charge per animal.
2) Storage Charge. If the animal is not called for within one (1) hour after
arrival at destination, a storage charge of $20 per day, or fraction thereof,
will be assessed. Reno Air will not release the animal until the storage
charges are paid. In the event that the animal is unclaimed after forty-eight
(48) hours, Reno Air will place the animal in an animal shelter. Reno Air
will not be liable for animals not called for within one (1) hour after
arrival at destination.
RULE 205. CARRY-ON BAGGAGE In addition to the maximum allowances stated in RULE 220 (Free Baggage
Allowance), subject to availability of acceptable on-board storage space,
each fare-paying passenger may carry on-board, without additional charge,
a handbag or pocketbook, an overcoat or wrap and one bag that will fit under
the passenger's seat.
When baggage is carried on-board the aircraft, unless Carrier allows other
arrangements, the baggage must be retained in the passenger's custody and
stored under a seat or in an overhead compartment approved for the carriage
of such baggage.
Carrier assumes no responsibility or liability for loss or damage to baggage
other than properly checked baggage.
Carrier may refuse to transport in the cabin any item whose weight, size
or character is deemed unsuitable for carriage in the cabin in Carrier's
sole discretion. On turboprop aircraft, Reno Air may require carry-on baggage
to be stored in a compartment inaccessible during flight.
RULE 215. CABIN-SEAT BAGGAGE When a fare-paying passenger requests that an item of baggage be carried
in the cabin, and it is determined by Carrier that the item is acceptable
as cabin baggage, but it is so fragile and/or bulky as to require the use
of a seat, the item will be accepted subject to the following conditions
and charges:
a) Cabin-seat baggage must be carried aboard the aircraft by the passenger,
and secured in a seat next to the passenger's seat.
b) The seat must be behind a bulkhead.
c) Baggage may not occupy a seat that is between any passenger and the aircraft
aisle or between any passenger and an aircraft exit.
d) Baggage must not protrude above the seat back and no one side may exceed
seventy-two (72) inches. Cabin-seat baggage must not exceed one hundred
sixty-five (165) pounds.
e) A seat for the cabin-seat baggage must be reserved in advance.
f) Carrier will charge the lesser of fifty percent (50%) of the applicable
full adult fare for the portion of the trip on which the extra seat is used
or 100% of any applicable adult fare provided the fare rules are met. Fuel/terminal
surcharges, when applicable, will be added on to the fare charged without
discount.
g) The cabin-seat baggage will not be included in determining free baggage
allowances or excess baggage charges.
RULE 220. FREE BAGGAGE ALLOWANCE A) Maximum Allowance. Carrier will accept, without charge, a passenger's
baggage as checked baggage for transportation between the points traveled
by the passenger, subject to the conditions of acceptance below.
1) For Transportation Solely Between Points Within the Continental United
States.
Carrier will accept a maximum of two (2) pieces not exceeding the maximum
outside linear dimensions and weight stated below.
2) For Transportation To/From International Points. Carrier will accept
the free baggage allowance set by the onward interline carrier.
3) Maximum Outside Linear Dimensions.
1st piece 62 inches
2nd piece 55 inches
4) Maximum Weight. No single piece may exceed seventy (70) pounds.
B) In addition to the maximum allowance stated above, Carrier will accept
as checked baggage, without additional charge the following articles:
1) A manually or battery operated wheelchair subject to the conditions in
RULE 195.
2) Braces or prosthetic devices.
3) One pair of skis or one set of golf clubs.
C) Pooled Baggage. When two or more fare-paying passengers traveling to
the same destination on the same flight(s) present themselves and their
baggage at the same time and place, their maximum allowance will be the
sum of their individual maximum allowances. Baggage in excess of the combined
maximum allowance will be subject to the excess baggage charge.
RULE 225. EXCESS BAGGAGE Baggage in excess of the maximum allowance specified in RULE 220 (Free
Baggage Allowance) will be accepted for transportation only under the conditions
and upon payment of excess baggage charges specified in the rule. Under
no circumstances will Carrier accept baggage which cannot safely be carried
on the aircraft due to its size, weight or character.
Each piece(s) in excess of the maximum number and each piece which has an
excessive maximum linear dimension will be subject to the charges prescribed
below.
First three pieces in excess $ 30 per piece
Fourth, fifth & sixth pieces in excess $ 50 per piece
Seventh piece of excess and over $100 per piece
Baggage connecting to other airlines will also be subject to the connecting
airlines' charges in addition to the originating carrier's charges. Carrier
will accept excess baggage for transportation on a space available basis
only.
RULE 230. BAGGAGE LIABILITY LIMITATIONS A) Baggage Liability - Domestic.
1) In delivering baggage or other property to Carrier for domestic transportation,
whether checked or otherwise placed into the custody of Carrier or one of
its employees, Carrier's liability, if any, should the baggage be lost,
damaged or delayed in delivery is limited to:
a) the lesser of the amount of provable damages actually sustained by the
passenger, or
b) $1,250, unless prior to departure of the flight the passenger elects
to declare a higher value on the property and pays the applicable additional
charges ($2,500 with respect to any wheelchair or other mobility aid for
a handicapped individual).
The actual damage sustained by the passenger for property that is lost shall
be measured by the fair market value of the property at the time it was
received by Carrier and not by the replacement value of the property. Subject
to the limitations set forth elsewhere in this Contract of Carriage, Carrier
will compensate the passenger for direct damages actually sustained up to
the limit of its liability set forth herein or the declared value of the
property, whichever is higher.
2) When the transportation is over the lines of Carrier and one or more
carriers with a limitation of liability of more than $1,250 for each fare-paying
passenger, and responsibility for loss, damage, or delay in delivery of
baggage cannot be determined, the liability limit of $1,250 for each fare-paying
passenger will be applied to all carriers.
3) A fare-paying passenger may, when checking in for a flight and presenting
property for transportation, declare a value on that property higher than
the $1,250 limit established by paragraph 1) above, up to a maximum declared
value of $2,500. The charge for excess value is $1 per $100 or fraction
thereof, by which the property's declared value exceeds $1,250. Maximum
charge is $13. A value cannot be declared for transportation of valuable/commercial
items (see Rule 230.C.3).
B) Baggage Liability - International.
1) In delivering baggage or other property to Carrier for international
transportation, whether checked or otherwise placed into the custody of
Carrier's or one of its employees, Carrier's liability, if any, should the
baggage be lost, damaged or delayed in delivery is limited to the lesser
of the amount of provable damages actually sustained by the passenger or
$20.00 per kilogram of baggage weight (up to a maximum of $635.00). The
actual damage sustained by the passenger for property that is lost shall
be measured by the fair market value of the property at the time it was
received by Carrier and not by the replacement value of the property. Carrier
will compensate the passenger for both direct and consequential damages
actually sustained up to the limit of its liability set forth herein.
2) When the transportation is over the lines of Carrier and one or more
carriers with a limitation of liability of more than $20.00 per kilogram
of baggage weight, and responsibility for loss, damage, or delay in delivery
of baggage cannot be determined, the liability limit of $20.00 per kilogram
of baggage weight will be applied to all carriers.
C) Exclusions From Liability.
1) When Carrier has exercised the ordinary standard of care, Carrier shall
not be liable for delay in delivery of any perishables, nor for damage to,
or damage caused by, fragile articles, liquids, or perishables which are
unsuitably packed and which are included in a passenger's checked baggage
with or without the carrier's knowledge. Carrier shall not be liable for
the damage or delay in delivery of a passenger's checked baggage accepted
pursuant to a limited release (See RULE 195).
2) Carrier assumes no liability for damage such as scratches, scuffs and
dents resulting from normal wear and tear.
3) Carrier assumes no liability for valuable/commercial items including
but not limited to money, negotiable papers, securities, irreplaceable business
documents/books, manuscripts/publications, jewelry, silverware, precious
metals, furs, antiques, artifacts, specialized/calibrated equipment, photographic
equipment including but not limited to video cameras and their accessories,
electronic equipment including but not limited to computers, computer printers
and their accessories, lifesaving medication, samples, liquids or perishable
items contained in checked or unchecked baggage.
4) Carrier assumes no liability for baggage/property carried on the aircraft
by the passenger (See RULE 205).
5) Carrier will not be liable for delivery by surface transportation of
checked baggage, at the passenger's point of destination where the baggage
is not presented by the passenger at least fifteen (15) minutes prior to
the scheduled departure time of a domestic flight and thirty (30) minutes
prior to the scheduled departure time of an international flight on which
the passenger is transported or where the passenger is transported on a
flight on which the passenger did not hold a confirmed reservation and the
passenger's luggage did not accompany the passenger on such flight.
6) When live animals are accepted for transportation according to conditions
and charges stated in RULE 200, Carrier will not be liable for loss or expense
due to the passenger's failure to comply with any condition stated in the
rule, and Carrier will not be responsible if the animal is refused passage
into or through any city, state or territory.
RULE 235. FLIGHT DELAYS/CANCELLATIONS (STANDBY PASSENGERS) Carrier shall have no liability or other responsibility for failing
to operate any flight according to schedule or for changing the schedule
of any flight, with respect to any passenger who does not hold a confirmed
reservation and a valid ticket for such flight, or who has not checked in
within the time limits set forth in this Contract of Carriage, or who may
be denied boarding fro any other valid reason.
RULE 240. FLIGHT DELAYS/CANCELLATIONS (CONFIRMED PASSENGERS) A) Reaccomodation. Carrier undertakes to use its best efforts to transport
with reasonable dispatch each fare-paying passenger who has a valid revenue
ticket and a confirmed reservation on a flight.
Times shown in timetables or elsewhere are not guaranteed, and form no part
of the Contract of Carriage. Carrier may, without notice, substitute alternate
carriers or aircraft, and may alter or omit stopping places shown on the
ticket in case of necessity. Schedules are subject to change without notice.
Carrier is not responsible or liable for making connections, or for failing
to operate any flight according to schedule, or for changing the schedule
of any flight.
When a fare-paying passenger holding a confirmed reservation on a flight
is delayed, canceled or denied boarding, Carrier will re-book the passenger
on its first available flight to the passenger's destination without additional
charge. If Carrier is unable to provide timely onward transportation, at
the passenger's request Carrier may, but is not required to, rebook the
passenger on another airline.
B) Amenities/Services. When a fare-paying passenger holds confirmed reservations
on a flight, Carrier may assume certain expenses incurred as a result of
a schedule irregularity resulting in a delay exceeding four (4) hours. Carrier
will advise the passenger of the available amenities and services.
In no event, however, will Carrier be required to pay for any amenities
or rerouting or other compensation to passengers whose flight is delayed
or canceled as a result of weather conditions or airport closure.
RULE 245. DENIED BOARDING COMPENSATION When Carrier is unable to provide previously confirmed space due to
more passengers holding confirmed reservations and tickets on a flight than
there are available seats on that flight (an "Oversale Situation"),
Carrier will take the actions specified in the provisions of this rule.
EXCEPTION 1: An Oversale Situation does not exist where Reno Air is unable
to accommodate passengers because of substitution of equipment of lesser
capacity. In such event, passengers denied boarding will be accommodated
under Rule 240.
EXCEPTION 2: No passenger will be eligible for compensation in an Oversale
Situation if the passenger is offered a seat in a section of the aircraft
other than that specified on the passenger's ticket at no extra charge.
If a passenger is seated in a section for which a lower fare applies, the
passenger shall be entitled to an appropriate refund.
EXCEPTION 3: No passenger will be eligible for compensation if his or her
ticket was issued at free or reduced fares available to employees within
the transportation industry.
EXCEPTION 4: No passenger will be eligible for compensation if Carrier arranges
for alternate air transportation at no additional cost (or for other transportation
that is accepted and used by the passenger) which, at the time arrangement
is made, is planned to arrive at the airport of the passenger's next stopover,
or if none, at the airport of the passenger's final destination (or, in
either case, an alternate airport acceptable to the passenger) within one
(1) hour after the scheduled arrival time of the passenger's original flight
or flights.
A) Definitions. For the purpose of this rule, a confirmed reservation means
space on a specific date and on a specific flight and class of service of
Carrier which has been reserved in Carrier's internal reservation system.
B) Request for Volunteers. In an Oversale Situation, Carrier will solicit
volunteers to relinquish their confirmed reserved space in exchange for
compensation determined by Carrier. The amount of compensation offered may
be increased in Carrier's discretion in order to induce volunteers. Such
compensation may include discount price coupons, positive space tickets,
space-available tickets or any other compensation selected by Carrier.
C) Boarding Priorities. No one will be denied boarding against his/her will
in an Oversale Situation until after volunteers are solicited to willingly
give up their reservations. If there are not enough volunteers, passengers
with confirmed reservations who have not already received boarding authority
will be permitted to board in the following order until all available seats
are occupied and the remaining passengers will be involuntarily denied boarding:
1) Passengers who are elderly or infirm to an extent that failure to carry
would, in Carrier's sole opinion, cause a severe hardship; unaccompanied
children under twelve (12) years of age; connecting passengers; and passengers
who would suffer severe hardships in Carrier's sole opinion.
2) Passengers other than noted in 1) above (including tour conductors accompanying
a group) will be accommodated in the order in which they present themselves
for check-in and boarding at the loading gate or other points(s) designated
by Carrier for such purpose.
NOTE: Accompanied children under twelve (12) years of age will be included
in the same category as the accompanying passenger.
D) Transportation for Passenger Denied Boarding. When Carrier is unable
to provide previously confirmed space in an Oversale Situation, Carrier
will transport the passengers who have been denied boarding (whether voluntarily
or involuntarily) without stopover on its next flight on which space is
available at no additional cost to the passenger.
E) Compensation for Passenger Denied Boarding. In addition to providing
transportation as described as described in paragraph D), Carrier will compensate
any passengers with a confirmed reservation involuntarily denied boarding
in an Oversale Situation, who (1) holds a ticket for confirmed space on
the oversold flight, (2) presented himself or herself for check-in at least
15 minutes before scheduled departure time and complied fully with Reno
Air's requirements as to ticketing and check-in procedures, and (3) otherwise
met all requirements for acceptance by Reno Air for transportation, as follows:
Carrier will tender liquidated damages in the amount of two hundred percent
(200%) of the value of the passenger's remaining flight coupon(s) (up to
a maximum of $400.00) to the passenger's next stopover, or if none, to the
passenger's destination. However, the compensation shall be fifty percent
(50%) of the amount described above, (and not more than $200.00) if Carrier
arranges for alternate air transportation at no additional cost, (or for
other transportation that is accepted and used by the passenger) which,
at the time arrangement is made, is planned to arrive at the airport of
the passenger's next stopover, or if none, at the airport of the passenger's
destination not later than two (2) hours after the planned arrival at the
airport of the passenger's next point of stopover, or, if there is no next
point of stopover, at the airport of the passenger's destination, of the
flight on which the passenger holds a confirmed reservation.
NOTE 1: If the offer of compensation is made by Carrier and accepted by
the passenger, such payment will constitute full compensation for all actual
or anticipatory damages incurred or to be incurred by the passenger as a
result of Carrier's failure to provide the passenger's confirmed reserved
space.
NOTE 2: At the passenger's option, Carrier may compensate the passenger
with a voucher for free or reduced rate transportation in lieu of monetary
compensation with a value equal to or greater than the monetary compensation
due.
3) Time of Offer of Compensation. The offer of compensation will be made
by Carrier on the day and at the time and place where failure to provide
confirmed reserved space occurs, and, if accepted, must be receipted for
by the passenger, provided, however, that when Carrier arranges, for the
passenger's convenience, alternate means of transportation that departs
prior to the time the payment may be made to the passenger, the payment
shall be made by mail or other means within twenty-four (24) hours after
the failure occurs.
RULE 260. REFUNDS A) Subject to the conditions stated below, in the event that a ticket
does not bear refund restrictions or Carrier is unable either to provide
the transportation specified on the tickets, to reroute the passenger timely
to his destination, upon request of the passenger, Carrier will refund the
ticket as indicated below:
1) If no portion of the ticket has been used, the refund will be the amount
equal to that paid.
2) If a portion of the ticket has been used, the refund will be the amount
equal to the lowest one-way fare (fifty percent (50%) on published round-trip
fares) from the airport of interruption to the destination based on the
fare type used.
B) In no instance will the amount refunded be greater than the amount paid.
C) Reno Air will not refund a ticket which does not indicate a confirmed
seat on Reno Air unless the ticket was issued by Reno Air.
D) Except as provided below, Carrier will refund to the person named as
the passenger on the ticket. Tickets which have been issued against a credit
card will be refunded only to the account of the person to whom such credit
card was issued. Tickets issued in exchange for a prepaid ticket advice
will be refunded only to the purchaser of the prepaid ticket advice unless
the purchaser agreed otherwise at the time of purchase. Tickets issued against
a government transportation request will be refunded only to the government
agency which issued the request, and, in the event the agency was an agency
of the United States Government, the refund shall be in the form of a check
payable to "Treasurer of the United States.".
E) Tickets will be refunded in the original form of payment.
F) The passenger must surrender the refunded ticket.
G) The refund must be requested within eighteen (18) months following the
date of purchase of the ticket.
H) All refunds/refund applications are subject to audit. Refunds are not
final until audit is complete.
I) If, at the time of application for a refund, evidence is submitted that
a company purchased the ticket on behalf of its employee or the travel agency
has made a refund to its client, such refund will be made directly to the
employee's company or the travel agency.
RULE 270. LOST TICKETS 1) General. When a passenger loses his/her ticket issued by Carrier,
or the unused portion thereof, Carrier will make a refund to the passenger
subject to the following conditions:
a) Time Limit. Application for refund must be submitted to Reno Air not
later than one month after the expiration date of the lost ticket on forms
prescribed by Reno Air for such refunds.
b) A service charge of $50 per ticket must be paid with respect to each
request for a refund of a lost/replacement ticket.
c) When Payable. The refund will be made a minimum of (120) days from receipt
of application for such refund, subject to d) and e) below.
d) Previous Use or Refund. The lost ticket or lost portion thereof must
not have been honored for transportation, or refunded to any person, prior
to the date of refund.
e) Indemnity. The person to whom the refund is made must agree in such form
as may be prescribed by Reno Air to indemnify Reno Air for any loss or damage
which it may sustain by reason of such lost ticket.
EXCEPTION: No service charge will be imposed for military passengers when
transportation is paid for with a U.S. Government Transportation Request.
2. Amount of Refund.
a) If no portion of the ticket has been used, the refund will be an amount
equal to the fare and charges paid.
b) If a portion of the ticket has been used, and:
i) The passenger has purchased a new ticket covering the same transportation
on Carrier as that covered by the unused portion of the lost ticket, the
refund will be an amount equal to the fare and charges paid for such new
ticket.
ii) The passenger has not purchased a new ticket covering the same transportation
as that covered by the unused portion of the lost ticket, the refund will
be an amount equal to the difference between the fare and charges paid,
and the fare and charges applicable to the transportation of the passenger
covered by the used portion of the ticket less the applicable service charge.
RULE 275. REFUNDS INVOLVING FOREIGN CURRENCY Carrier reserves the right to refuse to make any refund authorized by
this Contract in a currency other than that used in the purchase of the
ticket to be refunded or at a place other than that at which payment for
such ticket was made.
RULE 390. PREPAID TICKET ADVICE CHARGES For each Prepaid Ticket Advice issued by Carrier, Carrier will impose
a service charge of $25.00. This service charge is not subject to any discount
and cannot be refunded. The Prepaid Ticket Advice service charge will not
apply when prepayment is made by the Federal Government for official business.
RULE 395. PASSENGER FACILITY CHARGES AND SURCHARGES Carrier reserves the right to charge passengers for any surcharges,
passenger facility charges or other incremental charges imposed by airports
or by governmental regulation or authority. Unless otherwise stated, these
fees and charges are in additional to Carrier's published fare.
RULE 499. AMENITIES Fares paid are for transportation only. Amenities or lack of amenities
are not part of the contract, nor are they consideration for the fare paid.
RULE 500. RENO AIR EXPRESS Terms of this Contract of Carriage apply to flights operated as "Reno
Air Express" using the "QQ" designator code, unless a more
restrictive provision is contained in the Contract of Carriage of the carrier
operating such service, in which case the more restrictive term applies.
RULE 1000. APPLICABLE LAW Any provision herein which is contrary to any valid applicable law or
regulation shall be deemed modified or superseded to the extent necessary
to comply with such law or regulation.
